Disclaimer
The National Mining Association (NMA) provides this web site as a service to its members and the public. By using the NMA web site, the user agrees to comply with the NMA Terms and Conditions of Usage. NMA provides all information, files, data, and hyperlinks on the NMA web site on an "as is" basis. NMA makes no warranties of any kind with respect to the NMA web site or the information contained therein. Users interact with the NMA web site at their own risk. User further agrees to hold harmless NMA, its members, directors, officers, employees and agents from and against all claims, whether brought in contract or in tort, arising out of the usage of the NMA web site. Viruses
NMA uses procedures to attempt to locate and destroy, and thereby to avoid the spreading of computer viruses. However, due to the limitations of computer software in detecting and removing viruses, potential access to the NMA web site or NMA computers by third parties, hyperlinks to third party web sites out of NMA's control, or human error, NMA does not guarantee that viruses will never be transmitted by the NMA web site. These hyperlinks are provided for the convenience of the users of the NMA web site. However, NMA does not control the content, information, or files on these third party web sites. Therefore, user agrees that by using the NMA web site hyperlinks, they are doing so at their own risk. NMA makes no warranties of any kind with respect to any third-party web sites that are hyperlinked from the NMA web site.

Monitoring
NMA shall have the right, but not the obligation, to monitor the NMA web site in whatever form NMA deems appropriate, in NMA's sole discretion. If NMA exercises its right to monitor the web site, it shall be done for the purposes of quality control, compliance with applicable laws or regulations, and furthering user compliance with the NMA Terms and Conditions of Usage.

These Terms and Conditions of Usage agreed to by the parties constitute the entire agreement between the parties, and supersedes all previous oral or written agreements to the contrary. These Terms and Conditions of Usage shall be construed in accordance with the laws of the District of Columbia. The parties agree that by using the NMA web site, any claims arising out of such usage shall be brought in the courts of the District of Columbia, unless prohibited by law; and user expressly agrees to be subject to the jurisdiction of the District of Columbia courts.
