Water Quality

The U.S. Environmental Protection Agency (EPA) issued in April, 2010, guidance on water quality requirement for coal mines in Appalachia.  The guidance became effective immediately and relied on electric conductivity as the sole indicator of water quality impairment—establishing a de facto water quality standard that interfered with the states’ authority to set water quality standards and issue permits.  This guidance was struck down in NMA v Jackson.
